UK Family Court Support Hub - Child Arrangements Position & Witness Statement Writing Service Terms and Conditions

Last updated: 9 October 2026

Please read these Terms and Conditions carefully before purchasing the service.

By purchasing the service, you agree to these Terms and Conditions.

1. Who provides the service

The service is provided by Gemma Bailey, a sole trader, trading as UK Family Court Support Hub.

Business correspondence address:
80a Ruskin Avenue
Suite 830
Welling
ENG
DA16 3QQ

Email: ukfamilycourtsupporthub@protonmail.com

UK Family Court Support Hub is the customer-facing trading name used for this service. It is not a separate limited company or partnership.

The UK Family Court Support Hub – McKenzie Friend Advice Facebook group is a separate free community resource. The paid statement-writing service is provided by Gemma Bailey in her capacity as a sole trader.

2. The service and turnaround time

The service is a one-off document-writing service for individuals involved in child arrangements proceedings in the Family Court of England and Wales.

The service costs £99.99. This is the total amount payable by the customer. Gemma Bailey is not VAT registered and VAT is not charged separately.

The service consists of:

  • reviewing the information submitted by the customer through the designated online questionnaire;

  • preparing one draft position statement or one draft witness statement, as applicable to the service selected;

  • structuring the information into a clear and professional draft statement using appropriate court-appropriate language; and

  • providing the completed draft statement electronically by email.

The intended turnaround time is two working days, calculated from the date the completed online questionnaire is received, provided the service is open and accepting orders.

Working days are Monday to Friday, excluding UK bank holidays.

How the two-working-day turnaround is calculated

For the purposes of calculating the turnaround time, a completed online questionnaire received by 11:59 pm on a working day will be treated as received on that day.

A completed questionnaire received at or after 12:00 am on the following day will be treated as received on that following day, provided it is a working day.

The completed draft statement will be emailed to the customer by the end of the second working day after the date of receipt.

For example:

  • If a completed questionnaire is received at 11:59 pm on Monday, the draft statement will be emailed by the end of Wednesday.

  • If a completed questionnaire is received at 1:30 am on Tuesday, the draft statement will be emailed by the end of Thursday.

  • If a completed questionnaire is received on a Saturday, Sunday or UK bank holiday, it will be treated as received on the next working day.

The turnaround period does not begin when payment is made. It begins when the completed online questionnaire has been received.

The turnaround time applies only while the service is open and accepting orders. Any published temporary closure arrangements will apply as explained in Section 12.

3. Information used to prepare the draft statement

The draft statement will be prepared solely from the information provided by the customer through the designated online questionnaire.

The customer is responsible for ensuring that the information supplied is complete, accurate and sufficient for the service requested.

Gemma Bailey will not contact the customer to request missing, additional or clarifying information before preparing the draft statement.

If information is missing or unclear, the draft statement will be prepared using the information available.

Information provided after the online questionnaire has been submitted will not be added to the statement.

Customers should ensure that all information they wish to be considered is included in the questionnaire before submitting it.

4. What is not included

The £99.99 service does not include:

  • legal advice;

  • advice from a solicitor or barrister;

  • advice about the merits of a case;

  • a telephone, video or face-to-face consultation;

  • reviewing the customer's court papers;

  • reviewing previous witness statements or position statements;

  • reviewing court orders, judgments or directions;

  • reviewing Cafcass reports, safeguarding letters or other professional reports;

  • reviewing correspondence or evidence provided by the customer;

  • independent investigation or verification of information;

  • contacting the court, Cafcass, the other party or any other person on the customer's behalf;

  • filing or serving the statement;

  • attending court;

  • advocacy or speaking on the customer's behalf at court;

  • ongoing case support; or

  • any work or advice beyond preparing the one draft statement described in these Terms and Conditions.

5. Amendments and additional information

No amendments or revisions are included in the £99.99 service.

Once the completed draft statement has been provided to the customer, the service is considered complete.

The customer cannot provide further information after submitting the online questionnaire and request that it be incorporated into the statement.

If the customer requires further advice, assistance, document review or support after receiving the statement, they may contact UK Family Court Support Hub separately regarding its professional McKenzie Friend support. Any such support would be a separate service and is not included in the £99.99 statement-writing service.

6. Customer responsibility

The customer is responsible for:

  • providing complete and accurate information;

  • checking all information provided through the online questionnaire before submitting it;

  • checking the completed draft statement carefully when received;

  • deciding whether the completed draft statement accurately reflects their position or evidence;

  • deciding whether the draft statement is suitable for filing with the court;

  • making any necessary corrections to factual information before filing, where appropriate;

  • complying with any court directions relating to draft statements;

  • meeting all court deadlines; and

  • filing and serving the draft statement as required.

The customer should not assume that the draft statement is suitable for filing without checking it carefully.

Gemma Bailey cannot be responsible for errors or omissions resulting from inaccurate, incomplete or unclear information supplied by the customer.

7. No guarantee of outcome

The service is a document-writing service only.

No representation or guarantee is made about:

  • how the court will view the draft statement;

  • whether the court will accept or rely upon any particular information;

  • whether the court will make any particular order; or

  • the outcome of the customer's proceedings.

The court remains responsible for determining the issues before it and making any orders.

8. Not legal advice

The service does not constitute legal advice.

Gemma Bailey is a professional McKenzie Friend and is not a solicitor or barrister.

The service does not create a solicitor-client or barrister-client relationship.

Customers who require legal advice should obtain advice from a suitably qualified legal professional.

9. Reasonable care and skill

The service will be provided with reasonable care and skill.

Nothing in these Terms and Conditions is intended to exclude or restrict any legal rights or remedies that cannot lawfully be excluded or restricted.

10. Cancellation rights

Where the service is purchased online as a consumer, the customer will generally have a statutory 14-day cancellation period beginning on the day after the contract is entered into.

The customer may expressly request that work begins before the end of that 14-day period.

If the customer requests that the service begins during the cancellation period and subsequently cancels, they may be required to pay a proportionate amount for the service supplied up to the point at which the cancellation is communicated, where permitted by law.

Where the service has been fully performed following the customer's express request for it to begin during the cancellation period, and the customer has acknowledged that the right to cancel will be lost once the service has been fully performed, the statutory cancellation right will end where permitted by law.

The relevant request and acknowledgement will be presented to the customer before or during payment.

Nothing in these Terms and Conditions affects any statutory rights the customer may have.

11. Refunds

Where a customer has a statutory right to cancel, any refund will be dealt with in accordance with applicable consumer law.

Where the customer has expressly requested that the service begin during the cancellation period, an appropriate proportion of the price may be payable for services supplied before cancellation, where permitted by law.

Once the service has been fully performed following the customer's valid request for early performance and the required acknowledgement, the statutory cancellation right may no longer apply.

Nothing in these Terms and Conditions removes or limits any statutory right to a remedy where the service has not been provided in accordance with the law.

12. Service availability and temporary closure

The service may be temporarily unavailable, including during periods when Gemma Bailey is on holiday or otherwise unavailable to provide the service.

When the service is temporarily closed:

  • new purchases may be suspended;

  • the payment facility may be deactivated;

  • the online information questionnaire may be closed; and

  • advertising or promotional material may be paused or amended.

Customers should not make a payment while the service is displayed as unavailable.

Where a customer has already paid before a temporary closure but has not yet submitted the completed questionnaire, the customer should follow any specific instructions published about the closure and the date the service will reopen. The applicable turnaround time will be confirmed or calculated in accordance with the arrangements communicated to the customer.

Where a customer has submitted their completed questionnaire before a temporary closure, Gemma Bailey will communicate any material change to the expected completion date.

The two-working-day turnaround applies only when the service is open and accepting orders and does not require Gemma Bailey to work during a published period of temporary closure.

13. Court deadlines

The customer remains responsible for complying with all court deadlines.

Customers should allow sufficient time for the draft statement to be prepared, checked and filed or served before any applicable deadline.

The two-working-day turnaround is an intended service timeframe and does not alter any deadline imposed by the court.

Customers should not purchase the service if the requested turnaround would not leave them sufficient time to check and file or serve the completed document.

14. Accuracy and verification

Gemma Bailey does not independently verify the factual information supplied by the customer.

The draft statement will reflect the information provided by the customer, subject to appropriate drafting and structuring.

The customer remains responsible for the truth and accuracy of the information they provide.

Customers should not knowingly provide false, misleading or dishonest information.

15. Confidentiality and privacy

Information provided through the service will be handled in accordance with the UK Family Court Support Hub Privacy Policy.

Customers should read the Privacy Policy before submitting their information.

Because family court proceedings can involve sensitive personal information about the customer, children and other people, customers should only provide information that is relevant to the statement and requested by the online questionnaire.

16. Use of the completed draft statement

The completed draft statement is prepared for the individual customer's use in connection with their own child arrangements proceedings.

The customer may use the completed draft statement for the purpose for which it was prepared, including providing it to the court and other relevant parties where required.

17. Complaints

If a customer has a complaint about the service, they should contact:

ukfamilycourtsupporthub@protonmail.com

The complaint should explain the nature of the issue and provide sufficient information to allow it to be considered.

Complaints will be considered fairly and within a reasonable period.

Nothing in this complaints procedure affects the customer's statutory rights.

18. Limitation of responsibility

Nothing in these Terms and Conditions excludes or restricts liability or a customer's rights where doing so would be unlawful.

Subject to that, Gemma Bailey is not responsible for:

  • the outcome of the customer's family court proceedings;

  • decisions made by the court;

  • the customer's failure to provide complete or accurate information;

  • the customer's failure to check the completed draft statement;

  • the customer's failure to comply with court deadlines;

  • the customer's failure to file or serve the draft statement correctly; or

  • matters outside the scope of the service described in these Terms and Conditions.

The customer remains responsible for deciding whether and how to use the completed draft statement.

19. No third-party involvement

The service is provided directly by Gemma Bailey.

Dave Barma and the UK Family Court Support Hub Facebook group are not parties to the customer's contract for the paid draft statement-writing service unless expressly stated otherwise.

Payment for this service is made to Gemma Bailey in her capacity as a sole trader.

20. Changes to these Terms and Conditions

These Terms and Conditions may be updated from time to time.

The version applicable to a customer's purchase will be the version made available to the customer at the time the contract is entered into, subject to any changes required by law.

21. Governing law

These Terms and Conditions are governed by the law of England and Wales.

Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any applicable consumer rights concerning jurisdiction.

22. Acceptance

By purchasing the service, the customer confirms that they have:

  • read and understood these Terms and Conditions;

  • understood what is and is not included in the service;

  • understood that the statement will be prepared solely from the information provided through the online form;

  • understood that no amendments or additional information are included;
